These terms apply to all services delivered by Falandos AI. Confirming an engagement constitutes acceptance of these terms.
Applicability
These terms apply to the design, build and maintenance of AI colleagues for your business, as well as to advisory engagements such as a discovery call.
Our services
We deliver bespoke AI colleagues for Dutch SMEs according to the Starter, Pro and Custom tiers described in the Pricing section of the website. Specific functionality, integrations and deliverables are recorded in a quote before work starts.
Delivery and acceptance
An AI colleague is considered delivered once all functionality described in the quote has been built and tested. The acceptance window is two weeks: during this period you can request changes that fall within the original scope. After that the monthly retainer begins and the AI colleague goes into production.
Setup fee and monthly retainer
A one-off setup fee is invoiced at the start of the engagement, as agreed in the quote. Once live, a monthly retainer covers hosting, monitoring and maintenance. The monthly amount is invoiced in advance.
Pilot programme
The first three pilot customers receive 50% off the setup fee in exchange for permission to use their industry story as a case study. The recurring monthly amount stays at full price. Pilot status is confirmed in writing.
Pricing changes
For existing customers we may adjust the monthly retainer with at least 60 days' written notice before the effective date. Setup fees for new engagements may be adjusted freely and apply from the moment of a new quote. If a price change does not suit you, the standard monthly cancellation terms apply.
Cancellation
The monthly retainer is cancellable per month and ends at the close of the current billing period. The setup fee is one-off and non-refundable.
Intellectual property
The bespoke AI colleague — including prompts, configurations and custom integrations built specifically for you — remains entirely your property. Falandos AI retains the right to reuse generic patterns and building blocks that are not business-specific.
Confidentiality
All business-specific information you share during an engagement — processes, customer data, price lists, internal FAQs, integrations — is treated as confidential. We do not share it with third parties, do not use it for other customers, and do not publish anything without your explicit consent. This confidentiality applies indefinitely, also after termination of the engagement.
No specific outcome guarantees
We commit to delivering AI colleagues that correctly perform the tasks described in the quote. However, we do not guarantee specific business outcomes such as a particular conversion uplift, revenue impact, or customer-satisfaction score. Examples and case studies on the website are illustrative and not a commitment.
Liability
Our liability is capped at the total monthly retainer paid in the three months preceding an incident. We are not liable for consequential damages, lost revenue, or third-party downtime (model providers, integration APIs).
Force majeure
Neither party is liable for delay or inability to deliver as a result of force majeure — including but not limited to outages at model providers or integration APIs, internet outages, or natural disasters. In case of force majeure we will inform you as quickly as possible and work together on a solution.
Governing law and disputes
Dutch law governs this agreement exclusively. Disputes that cannot be resolved amicably are submitted to the competent court in Amsterdam.
